The following describes the terms and conditions on which HopAround.net offers you access to our services. By using the services of HopAround.net, you are deemed to have accepted these terms and conditions. Our posting of amended and/or additional terms may amend these terms and conditions on our site and such amendments shall become immediately effective.

User Agreement

This user agreement ("agreement") is a legal agreement between you, the user of HopAround.net ("user") and RemitCard, Inc., a duly registered corporation of the Philippines, the owner and operator of www.HopAround.net ("HopAround.net” or “website"). This agreement governs your rights and obligations arising out of or relating to your use of the website and services therein.

HopAround.net is committed to protect the privacy of the users of the website and will use the information submitted by the users according to the terms as described in the Privacy Policy.

Acceptance of the Terms and Conditions

Your access to or use of HopAround.net and its services shall be deemed your acceptance to be bound by the Terms and Conditions in the use of this website and the Privacy Policy set forth. If you do not fully agree with any of Terms and Conditions and the Privacy Policy of HopAround.net, please refrain from accessing or using the website and its services.

HopAround.Net Service Description and General Terms

HopAround.net is a P2P (Person-to-Person) web portal that provides the platform where community-based individuals, companies and organizations, called the Micro Tourism Service Provider or MTSP in this website, can post their offering of  tourism-related services or products around their community’s tourism sites and where the local or foreign tourist, while planning their trips, can visit and search the website for these postings, inquire, negotiate and finalize arrangements directly with the concerned MTSP. All transactions subsequently generated are consummated through the settlement system of HopAround.net.

Other than providing the venue to bring the MTSP and the tourist together and provide the conduit for the payment of consummated transactions, the website has no other participation whatsoever in the actual transaction involving any MTSP or tourist. HopAround.net has no control over the quality, safety or legality of the posted services, the truth or accuracy of the postings, the ability of the MTSP to perform or deliver his posted service or the ability of inquiring tourist to pay for the service. HopAround.net cannot guarantee that an MTSP or the tourist will actually complete a transaction.

In the event that an MTSP has a dispute with a tourist and vice versa, HopAround.net (and all its personnel) is deemed released from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such transaction.

Only such items that are deem permissible service offerings and have not been otherwise declared illegal or outside the commerce of man by competent authorities can be registered in HopAround.net. HopAround.net reserves the right to disallow or prevent the posting of services which, in HopAround.net sole and exclusive judgment, are inappropriate for HopAround.net and the community it serves.

Acceptable Uses and Users of HopAround.net

1. Micro Tourism Service Provider or MTSP
   
   This user, upon his registration with HopAround.net as an MTSP, subject to these Terms and Conditions and the Privacy Policy, will be entitled to post his service offerings and other related materials on the page provided for by the website for MTSP’s. The MTSP agrees that he shall use the website only for lawful purposes. The MTSP agrees and consents that his postings, including his contact details, or any content posted by him on the website may be accessed by all users of the website so that inquiries on the service can be asked directly through the chat and quote me feature of the website, enabling the negotiation for the best terms and the payment of deals or transactions made. The MTSP agrees to the payment or settlement scheme of HopAround.net and the service charges included in the scheme.

2. Tourist
   
   The Tourist, upon his registration with HopAround.net as a Tourist, subject to these Terms and Conditions and the Privacy Policy, agrees that any personal data received from HopAround.net is for the purpose of answering his queries, accepting offers made by the MTSP and confirming business transactions made. The Tourist shall use the website only to search for destinations he may want to visit and the services available or offered by the MTSP. Via the chat and quote me feature of HopAround.net, the Tourist can negotiate directly with the MTSP. The Tourist agrees to the payment or settlement scheme of HopAround.net and the service charges included in the scheme.

Prohibited Uses for All Users

Users of HopAround.net agree not to use the website for any of the following purposes which are expressly prohibited:

1. All users are prohibited from violating or attempting to violate the security of HopAround.net, including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail. Violation of system or network security may result in civil or criminal liability.

2. All users shall not use the website (1) for transmitting, distributing or storing material in violation of any applicable law or regulation; or (2) in any manner that will infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others; or (3) in any manner that is libelous, obscene, threatening, abusive or hateful. In particular, all users shall not print, download, duplicate or otherwise copy any personally identifiable information about other uses (if any). All unsolicited communications of any type to users is strictly prohibited.

3. Users shall not use the website if they do not have legal capacity to form legally binding contracts.

4. MTSP’s shall not post any service offerings on the website which contains any false, inaccurate, misleading or libelous content or contains any computer virus. The service offerings shall not be fraudulent or involve sale of counterfeit goods.

5. Users shall not engage in spamming, including but not limited to any form of emailing that is unsolicited.

6. Users shall not delete or revise any content or material posted by any other person or entity.

Change, Interruption or Termination of Service

HopAround.net reserves the right to modify, vary, alter or otherwise change any or all of its services and terms and conditions upon which these services are provided without prior notice to HopAround.net users. HopAround.net shall in no event and to any extent whatsoever be held responsible for interruptions of services due to reasons beyond its reasonable control. Additionally, HopAround.net may without prior notice to its users go offline or otherwise be unavailable for necessary system maintenance and upkeep. Furthermore, HopAround.net may, without prior notice to its users, terminate the provision of its services to its users and shall, subject to verification and confirmation, reimburse to the tourist payments made for services not yet availed of, less the 30% already remitted to the MTSP and remit the payment for services already performed by the MTSP to the tourist.

Breach

Without limiting other remedies, HopAround.net may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate an MTSP’s registration and/or refuse a tourist to send inquiries on posted services of the MTSP’s on the following instances:

• if the MTSP or the tourist breaches any of the terms and conditions of use;
• if HopAround.net is unable to verify or authenticate any information provided by the user;
• if HopAround.net believes that the user's actions may cause legal liability for the user, other users or HopAround.net;
• If the user acquires 4 negative feedback ratings. – The rating system will be finalized so this is subject to further changes as per the succeeding paragraph

Banning Due To Negative Feedback Ratings

A user’s feedback rating is the reputation of the user given by other members of the community. When a user has acquired 3 negative feedback ratings a warning will be sent to the user via e-mail. Should the user acquire an additional negative feedback rating then the user shall be informed via e-mail that they have been banned from the HopAround community.

Users may contest the banning within 48 hours of receiving the notice by sending an e-mail to support@HopAround.net, where customer service shall review the circumstances surrounding the negative feedback received and act accordingly.

Furthermore, you may not post any service in HopAround.net (or consummate any transaction that was initiated using our service) that, could cause the website or RemitCard, Inc. to violate any applicable law, statute, ordinance or regulation. The posting of such services shall warrant immediate expulsion from www.HopAround.net. You shall be informed via e-mail of your expulsion from the site.

Added Security Measures and Actions on Posting of Personal Information

Due to incidences of fraud that is very prevalent in websites such as this website, www.HopAround.net shall be taking extra precautionary measures and actions on the posting of personal information such as phone numbers on the message board and uploading images containing contact information.

All pictures and new information posted shall be screened by HopAround customer support. Should customer support encounter data and/or images giving out personal information, the HopAround customer service representative shall delete the said data and/or images. You (the user) shall be sent an e-mail warning advising of the deletion of information. Next posting of similar upload would mean photo take down plus two weeks suspension of account with a corresponding e-mail. On the third posting of the same content, the same procedure will happen plus a month of account suspension and final e-mail warning. On the fourth time, the account will be permanently banned.

Intellectual Property Rights

The website, its services and any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components, are the exclusive intellectual property of RemitCard, Inc. and are protected under intellectual property laws and treaties.

Disclaimer of Warranties

RemitCard, Inc. makes no and hereby specifically disclaims all warranties, express or implied, including, without limitation, those of merchantability, non infringement and fitness for a particular purpose, with respect to the website and services therein. User assumes the entire risk as to the results and performance of the website and the services therein to the exclusion of RemitCard, Inc.

Limitation of Liabilities

RemitCard, Inc. will not be liable to any user or any third party for any and all damages, however classified or categorized, arising out of or related to the use or non-use, misuse, availability or reliance on the website and the services therein notwithstanding the fact that RemitCard, Inc. shall have been informed or notified of the possibility of the instance of such damages.

Disclaimer of SMS (Short Messaging Service) Use

• HopAround.net is not responsible for any message submission delays that may be experienced from its SMS (short messaging service) application.
• HopAround.net is not responsible for any ad expiration delays that may be experienced from its SMS (short messaging service) application.
• HopAround.net is not responsible for any delay experienced from its SMS (short messaging application) as a result of network congestion or telecom provider inadequacies.
• The SMS (short messaging service) application of HopAround.net should not be considered as completely reliable in receiving information or advice from us in general as possibilities of technical and network related glitches beyond HopAround.net control may arise. HopAround.net does not guarantee that its SMS (short messaging service) level of availability will be maintained at a 100% uptime as maintenance related activities may be undertaken at anytime deem fit for which case HopAround.net will not be held liable.

Choice of Law and Forum

This agreement, the use of the website and the services therein shall be governed by the laws of the Republic of the Philippines. User expressly agrees that any and all dispute relating to or arising out of this agreement, the use of the website and the services therein shall be subject to the exclusive jurisdiction of the appropriate courts of the Republic of the Philippines. User hereby expressly consents to the exercise of personal jurisdiction by the courts of the Republic of the Philippines.
